Welcome to the User Agreement (the "Agreement" or "User Agreement") for Cuties websites (the "Website"). This Agreement describes the terms and conditions applicable for your use of our services available under the domain and sub-domains belonging to Cuties and the general principles for the websites of our subsidiaries and affiliates. If you do not agree to be bound by the terms and conditions of this Agreement, please do not use or access our services. If you have any questions with regard to our User Agreement, or if you do not understand the User Agreement, please contact: legal@cuties-tools.com.

Although effort is made to provide accurate and complete information, Cuties makes no claims, promises or guarantees about the accuracy, completeness, or adequacy of the contents of the Website and expressly disclaim liability for errors and omissions in the contents of the Website. You agree to use your own efforts to verify the authenticity and accuracy of any information posted on the Website, whether by Cuties staff members, third-parties or affiliates, or by advertisers. Neither Cuties assume any legal liability for the accuracy, completeness, or usefulness of any information, service, or content disclosed herein nor freedom from computer virus, and do not represent that use of such information, service, or content would infringe on privately owned rights.

Cancellations & Refunds

Once you submit payment information, you can cancel at anytime and you will not be billed any further. Free trials are offered on all packages so you have a chance to use the website builder service before you purchase. Should you have any questions or require a refund, please contact us as soon as possible.

For website owners: I understand the following rules and regulations that pertain to building a website with Cuties

I hereby authorize Cuties and its agents, employees, and representatives, to publish my pictures and/or pictures I am submitting for the purpose of advertising on my website. I hereby grant them the sole and express right of publication on their website and/or corporate promotions, and strictly prohibit the publication of this picture on any other website. I also hereby transfer all copyright rights to Cuties and authorize them to pursue legal action against anybody who infringes on this copyright fully permissible by law.

I agree to hold them harmless from any liability arising from the publication of these pictures and further agree to bear any and all liabilities resulting from the publication therein. I understand that Cuties is only a website management software. Cuties provides neither advice nor participation in the conduct of my business. Cuties only sells the use of its website building software and is not further involved in my business in any way. I also hereby declare that I am over 18 years of age.

I hereby declare that I am over 18 years of age

1. The website I build on Cuties is my responsibility in full. Cuties does not monitor content on the websites of their subscribers. Cuties is not responsible for any of the content on my website and nothing contained in this agreement imposes any obligation upon Cuties to monitor or review my content or the content of my end-users at any time. I remain solely responsible for content posted on my site and any liability generated therefrom. I hereby warranty and represent that the content on my site does not infringe on the intellectual property rights, privacy rights, or publicity rights of any third party; depicts only consenting adults over the age of 18 when originally produced; and complies with all applicable laws, statutes, ordinances, and regulations, including but not limited to, 18 U.S.C. § 2256, 2257 & 2258A. In the event a dispute arising from claims arising from the content on my site, I agree to indemnify, defend, reimburse and hold harmless Cuties from and against any and all such claims and liabilities.

2. If I am purchasing premium services from Cuties, I am responsible for keeping track of my payment dates at all times. Cuties may contact me as the payment comes up for expiration; however, they are not responsible for giving me an extension if I cannot be reached.

3. I understand that my website will expire if payment is not received on time.

4. Cuties reserves the right to refuse the use of photos and text that are illegal, pornographic or infringe a copyright agreement. Because Cuties does not monitor your content, Cuties reserves the right to remove any photos as a result of a complaint from your website visitor.

5. I understand that Cuties reserves the right to add limitations or increase the pricing on my account for any reason, including but not limited to: excessive use of system resources; hotlinking to images or videos hosted on resources owned or rented by Cuties; any other reason at the sole discretion of Cuties. I have the option of continuing my subscription or cancelling at the end of the term.

6. I understand that I am to keep all payment information on hand, and be aware of when my website expires each month.

7. I agree my business will only provide services which are legal in my jurisdiction. It is my full responsibility to verify that all services I offer are legal in my jursidiction.

8. I agree no materials presented on my Website may contain graphic descriptions and depictions of explicit, offending, or disturbing activities.

9. I agree that Cuties retains legal ownership of all designs or graphics created by Cuties. Once my subscription ends, I no longer have the right to use any designs or graphics created by Cuties and I agree to delete all copies of images, designs and graphics that are created by Cuties. I also agree that if Cuties uses my photos to create the header images, I am the producer of the original content and they are merely publishing my original content, along with some design elements.

10. I agree that I am the rightful owner to all content that I solely create on my website. Even after my subscription ends, I hold all rights to content that I had solely created.

11. I agree that Cuties will not actively monitor the content of the websites being resold by Cuties and at Cuties' sole discretion, may disclose any content or records concerning my account as necessary to satisfy any law, regulation, or other legal/governmental request, or to properly operate Cuties' network and protect any of Cuties' customers. Cuties will investigate complaints of a violation of a third-party's rights, or of this Agreement. Cuties will cooperate with those attempting to minimize Internet abuse and reserve the right to institute "filters" or other mechanisms for that purpose. Cuties will cooperate with law enforcement authorities and reserve the right to notify such authorities if it suspects that I or any of my end-users are engaged in illegal activities. Nothing contained in this Section, or anywhere in this Agreement, is intended to bestow any rights on any third party, and no third-parties shall be entitled to enforce any terms of this agreement between the parties.

I understand that Cuties is only an advertising agency, no different from the yellow pages. Cuties provides neither advice nor participation in the conduct of my business. Cuties only sells space for advertising and are not further involved in my business in any way.
